WWP originally filed this action in 2004 challenging the BLM's renewal of grazing permits in the Jarbidge Resource Area (JRA), covering a large expanse of Southern Idaho. At issue on appeal, was whether the district court erred in denying WWP fees under the Equal Access to Justice Act (EAJA), 28 U.S.C. 2412(d)(1)(A).
