Under Federal Rule of Evidence 201, a court may take judicial notice of matters of public record without converting a motion to dismiss into a motion for summary judgment, but a court cannot take judicial notice of disputed facts contained in such public records. The incorporation-by-reference doctrine prevents plaintiffs from selecting only portions of documents that support their claims, while omitting portions of those very documents that weaken or doom their claims.The Ninth Circuit addressed and clarified when and how the district court should consider materials extraneous to the pleadings at the motion to dismiss stage via judicial notice and the incorporation-by-reference doctrine. In this case, plaintiffs appealed the district court's dismissal of an action under the Securities Exchange Act of 1934. The panel held that the district court erred in part by judicially noticing some facts, but properly took notice of the date of Orexigen's international patent application for Contrave. Therefore, the panel reversed and remanded for clarification on Exhibit D, reversed the district court's judicial notice of Exhibit E, and affirmed the judicial notice of Exhibit V. The panel also that the district court abused its discretion by incorporating certain documents into the complaint and properly incorporated others. The panel reversed the district court's incorporation-by-reference of Exhibits B, C, F, H, R, S, and U, and affirmed the incorporation of Exhibits A, I K, L, N, O, P, and T. The alliance filed suit alleging that the Forest Service violated the National Forest Resource Management Plan after approving the Lost Creek Project, which proposed landscape restoration activities on approximately 80,000 acres of the Payette National Forest. The Alliance also raised claims under the National Environmental Policy Act (NEPA) and the Endangered Species Act (ESA).The panel held that the final Record of Decision (ROD) for the Lost Creek Project was arbitrary and capricious because the standards, guidelines, and desired conditions that determine the forest conditions for Management Prescription Categories (MPC) 5.1 were different from those for MPC 5.2. The panel also held that the Forest Service's decision to adopt a new definition of "old forest habitat" for the Lost Creek Project area was arbitrary and capricious, and a violation of the National Forest Management Act. The panel held, however, that the Project's minimum road system designation was not arbitrary or capricious where the Forest Service fully explained its decision in selecting an alternative and considered each of the factors listed under 36 C.F.R. 212.5; the Forest Service did not violate NEPA by improperly incorporating, or "tiering to," the Wildlife Conservation Strategy (WCS) amendments or the WCS draft environmental impact statement; and challenges to the Forest Service's failure to reinitiate consultation with the U.S. Fish and Wildlife Service for the endangered bull trout under Section 7 of the ESA was moot. The Ninth Circuit affirmed the district court's judgment for the United States in an action seeking to collect delinquent federal excise taxes and penalties for the manufacture of tobacco products under 26 U.S.C. 5701. Determining that it had jurisdiction over the appeal, the panel held that the amended judgment sufficiently specified both the amount of money due to the plaintiff and a formula for computing that amount of money.The panel also held that a tobacco manufacturer located on trust land was subject to a federal excise tax applicable to all tobacco products manufactured in the United States under 26 U.S.C. 5702. In this case, King Mountain manufactures and grows tobacco products on lands held in trust by the United States, within the boundaries of the Yakama Nation. Finally, the panel rejected King Mountain's claim of exemption based on either the General Allotment Act of 1887 or the Treaty with the Yakamas of 1855. View "United States v. The Ninth Circuit granted a petition for review of the BIA's decision finding petitioner ineligible for cancellation of removal. The panel held that the BIA's determination that witness tampering under Oregon Revised Statutes 162.285 was a crime involving moral turpitude did not warrant deference under Skidmore v. Swift & Co., 323 U.S. 134 (1944), because the agency's analysis directly conflicted with circuit precedent, and was inconsistent both internally and with prior BIA decisions.The panel held that Oregon Revised Statutes 162.285 was not categorically a crime involving moral turpitude because the statute captures conduct that was neither fraudulent nor base, vile, or depraved. Although the statute was divisible, the subsection that formed the basis for petitioner's conviction was likewise not a categorical match for a crime involving moral turpitude. In an action under maritime law, a boat owner filed suit against his friend, who was driving the boat when it crashed into a passenger ferry. After the friend died from his injuries, his wife filed suit against the owner and GGB, which owns the ferry. The owner filed a cross-claim against GGB and a counterclaim against the wife.The Ninth Circuit affirmed the district court's grant of judgment as a matter of law to the owner. The panel applied maritime law and held that a boat owner who is a passenger on his boat has no duty to keep a lookout unless the owner-passenger knows that the person operating his boat is likely to be inattentive or careless or the owner-passenger was jointly operating the boat at the time of the accident. The panel also held that joint operation is not viewed over the course of the entire trip, but instead at the time immediately preceding and concurrent with the accident. View "Holzhauer v. The Ninth Circuit affirmed the district court's dismissal of an action brought by for-hire drivers challenging a Seattle ordinance that establishes a multistep collective bargaining process between "driver-coordinators," such as Uber and Lyft, and for-hire drivers who contract with those companies. The panel held that the drivers' claims under the National Labor Relations Act were unripe because they failed to allege an injury in fact that was concrete and particularized. In this case, even assuming arguendo that the disclosure of drivers' personal information to the union under the ordinance was imminent, the disclosure was neither a concrete nor a particularized injury. The Ninth Circuit granted a petition for review of the EPA's 2017 order maintaining a tolerance for the pesticide chlorpyrifos. In this case, the EPA did not defend the order on the merits but argued that despite petitioners having properly-filed administrative objections to the order more than a year ago and the statutory requirement that the EPA respond to such objections "as soon as practicable," the EPA's failure to respond to the objections deprived the panel of jurisdiction to adjudicate whether the EPA exceeded its statutory authority in refusing to ban use of chlorpyrifos on food products. The panel held that obtaining a response to objections before seeking review by this court was a claim-processing rule that did not restrict federal jurisdiction, and that could, and here should, be excused. Accordingly, the court vacated the order and remanded to the EPA with directions to revoke all tolerances and cancel all registrations for chlorpyrifos within 60 days. The Ninth Circuit reversed the district court's dismissal based on lack of jurisdiction of plaintiff's complaint under the Federal Tort Claims Act (FTCA). Plaintiff sought damages suffered as a result of his removal from the United States in violation of this court's temporary stay of removal.The panel held that 8 U.S.C. 1252(g) did not deprive it of jurisdiction to hear the FTCA claims of a noncitizen who was wrongfully removed in violation of a court order. Therefore, the district court erred in holding otherwise. The panel held that a decision or action to violate a court order staying removal fell outside of the statute's jurisdiction-stripping reach. Even if the panel agreed that plaintiff's claims tangentially arose from the execution of his removal order, the panel would still retain jurisdiction because the Attorney General lacked the authority, and thus the discretion, to remove him. Finally, the panel rejected the government's alternative argument that plaintiff's claims were barred by the FTCA's foreign country exception. View "Arce v. United States" on Justia Law

If a plaintiff would be entitled under a contract or statute to future attorneys' fees, such fees are at stake in the litigation and should be included in the amount in controversy. The Ninth Circuit reversed the district court's order remanding this action to state court under the Class Action Fairness Act (CAFA). The panel held that the district court erred in concluding that Swift failed to prove that the matter in controversy exceeded the sum or value of $5 million, as required for jurisdiction under CAFA. The panel held that defendants retained the burden of proving the amount of future attorney's fees by a preponderance of the evidence. Finally, the panel rejected plaintiff's contention that future attorneys' fees should not be included in the amount in controversy because they were inherently speculative. View "Fritsch v. The Ninth Circuit held that the BIA erred in finding that petitioner's conviction for child abuse and neglect under Nevada law was categorically a "crime of child abuse" under 8 U.S.C. 1227(a)(2)(E)(i). The panel held that it was bound by this circuit's opinion in Martinez-Cedillo v. Sessions, No. 14-71742, 2018 WL 3520402 (9th Cir. July 23, 2018), which deferred to the BIA's interpretation, in Matter of Soram, 25 I. & N. Dec. 378 (BIA 2010), that the generic crime of child abuse includes acts and omissions that create at least a "reasonable probability" that a child will be harmed. In this case, the Nevada statute was broader than the federal generic crime and there was a realistic probability that Nevada could prosecute conduct under its statute that fell outside the scope of the federal generic crime.
